Moviecritter does not control the Content posted and does not guarantee the accuracy or integrity of such Content. Moviecritter shall not be liable for any statements or conduct of any third party using the service. By using moviecritter you may be exposed to Content that is indecent or objectionable.   4. Liability
    Moviecritter will not be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content. Moviecritter will not be liable for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available on moviecritter. Moviecritter assumes no responsibility for the timeliness, deletion, miss-delivery or failure to store any User content, communication or personal settings.


  5. Limitation of Liability
    Whatever the legal grounds, CHIP Communications excludes any claim for indemnity unless the damage results from intention or gross negligence of CHIP Communications or its legal agent or vicarious agent. Liability for damage claims based only on ordinary negligence against CHIP Communications (including its legal and vicarious agents and executive employees) shall exist only if CHIP Communications breaches a cardinal obligation under this agreement. In the event of ordinary negligence, the amount of claims is limited to typical and foreseeable damages. Claims for indemnity against CHIP Communications prescribe after the expiry of 12 months from the date on which the right arose, unless they are based on civil and willful offense.


  6. Indemnity
    You agree to indemnify and hold moviecritter, its officers and employees exempt from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, transmit, post or otherwise make available through moviecritter.


  7. Termination
    Moviecritter may remove any Content and accounts from moviecritter at any time for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content), or for no reason at all. Upon termination of your account, your right to use movievritter will immediately cease. Violating these terms will result in termination of your ability to upload further content. We reserve the right to ban any individual uploader from using our services for any reason. If you wish to terminate your moviecritter account, you may simply discontinue using the Service.


  8. Miscellaneous
    These Terms shall be governed by German Law, excluding private law and the provisions of the United Nations Convention on Contracts for the International Sale of Goods that have been adopted by German Law. Place of Performance and exclusive place of jurisdiction, insofar as legally admissible, shall be Munich.
